Unless explicitly stated otherwise by KATZA, the agreement between KATZA and the buyer is formed by the mere placement of the order. Commencement of performance constitutes definitive confirmation, unless this has explicitly and in writing been done with reservation.

Article 3: Cancellation
Any cancellation of an order must be made in writing. In the event of cancellation, the buyer owes a fixed compensation for standard goods amounting to 20% of the total order amount. For personalized goods and custom work, 100% of the price will always be charged upon cancellation.

Article 4: Delivery times and additional costs
The stated delivery times are communicated purely as an indication and are therefore non-binding. Exceeding these deadlines does not entitle the buyer to any compensation, interest, or dissolution of the agreement. Any additional costs arising from a shorter delivery period than the regular or agreed period – at the buyer's request – will be fully passed on to the buyer through a price increase.

Article 6: Conformity and complaints procedure
When purchasing at our company premises, the buyer explicitly acknowledges, by the mere acceptance of the goods, that the merchandise conforms to the order and is free from any visible defects. If the goods are shipped, the buyer must inspect them immediately upon receipt.

To be valid, any complaint due to visible defects or non-conformity must be reported to KATZA by registered mail within eight (8) days of delivery. Hidden defects can only give rise to compensation if they are notified by registered mail within three (3) months of receipt. However, KATZA cannot be held liable for hidden defects.
Article 7: Payment terms and default
Unless otherwise agreed, invoices are payable no later than the stated due date by electronic transfer to the bank account number stated on the front of the invoice. In the absence of a specific due date, invoices are payable within eight (8) days of the invoice date.

Invoices must be protested by registered mail within eight (8) days of receipt, failing which the right to protest lapses. After the expiry of this period, the invoice is deemed to have been unconditionally accepted.
In the event of non-payment on the due date, the outstanding invoice amount will automatically and without prior notice of default be increased by a fixed compensation clause of 10% (with a minimum of € 50.00) and increased by default interest of 10% per year.
Article 8: Retention of title
The delivered goods remain the exclusive property of KATZA until the date of full payment of the principal sum, costs, and interest by the buyer. All possible costs associated with the return of the goods shall be borne by the buyer.
The buyer is obliged to inform KATZA in writing at the time of ordering if the ordered goods will be placed in real estate rented by the buyer. The buyer is liable for all damages if he has not informed the landlord in writing of KATZA's retention of title.

Standard combinations of table runners, placemats, bread baskets, and menu books can be returned or exchanged within fourteen (14) days of purchase. Custom-made or personalized combinations are explicitly excluded from this right of return and exchange.

Article 10: Competent court and applicable law
In case of dispute, and unless mandatory law dictates otherwise, the courts of the district of Tongeren shall have exclusive jurisdiction. Belgian law shall apply to the exclusion of any other legal system.
